These Terms of Service govern your use of exoticcarimports.com and all services provided by Exotic Car Imports LLC (“ECI”, “we”, “us”), located in Virginia Beach, Virginia.
1. ACCEPTANCE OF TERMS
By accessing or using our website, registering an account, placing a bid, or submitting a vehicle, you agree to be bound by these Terms. If you do not agree, do not use our services.
2. ELIGIBILITY
You must be at least 18 years old and legally capable of entering binding contracts to use our platform. By registering, you represent and warrant that you meet these requirements.
3. ACCOUNTS
You are responsible for maintaining the confidentiality of your account credentials. You are responsible for all activity that occurs under your account. Notify us immediately of any unauthorized use at [email protected].
4. AUCTION TRANSACTIONS
4.1 All bids are binding offers to purchase. Winning bidders are legally obligated to complete payment.
4.2 A 5% buyer’s premium (capped at $7,500) is added to all winning bids and charged to the card on file.
4.3 Full vehicle payment must be completed within 7 business days via bank wire or Escrow.com.
4.4 ECI acts as a marketplace facilitator. The sale contract is between buyer and seller. ECI is not a party to the vehicle purchase agreement.
5. SELLER SUBMISSIONS
5.1 Sellers represent that they have legal title or authority to sell the submitted vehicle.
5.2 Sellers grant ECI the right to photograph, film, and market the vehicle.
5.3 ECI reserves the right to decline any submission at its sole discretion.
5.4 A seller’s fee of 4.5% applies on successful sales. No fee is charged if the vehicle does not sell.
5.5 Sellers must respond to buyer inquiries and complete transfer of title within the agreed timeframe.
6. PROHIBITED CONDUCT
You agree not to: place bids without genuine intent to purchase, manipulate auction outcomes, submit vehicles with fraudulent titles or misrepresented condition, use automated tools to interfere with auctions, or use the platform for any unlawful purpose.
7. VEHICLE DESCRIPTIONS
ECI makes reasonable efforts to accurately describe all vehicles. All vehicles are sold as-is. ECI does not warrant the accuracy of seller-provided information and encourages independent inspections.
8. PAYMENT PROCESSING
Credit card information is processed securely via Stripe. ECI does not store card numbers. By adding a card, you authorize ECI to charge the buyer’s premium upon winning an auction.
9. IMPORT & COMPLIANCE
ECI facilitates the importation of European vehicles to the United States. Buyers acknowledge that import timelines, duties, and compliance requirements are estimates. ECI is not liable for delays caused by customs authorities or shipping carriers.
10. LIMITATION OF LIABILITY
To the maximum extent permitted by law, ECI shall not be liable for any indirect, incidental, or consequential damages arising from use of the platform. ECI’s total liability shall not exceed the buyer’s premium paid on the relevant transaction.
11. INDEMNIFICATION
You agree to indemnify and hold harmless ECI, its officers, employees, and agents from any claims arising from your use of the platform or violation of these Terms.
12. MODIFICATIONS
ECI reserves the right to modify these Terms at any time. Continued use of the platform following changes constitutes acceptance of the revised Terms.
13. GOVERNING LAW
These Terms are governed by the laws of the Commonwealth of Virginia, without regard to conflict of law principles.
